VARIATION

 

1.          Insert in numerical order in the General Clause Index of the award published 25 October 2002 (336 I.G. 885) following new clause number and subject matter:

 

1.39     2002 State Wage Case

 

2.          Insert after subclause 1.38, Workplace Flexibility, the following new subclause:

 

1.39  2002 State Wage Case

 

The rates of pay in this award include the adjustments payable under the State Wage Case 2002.  These adjustments may be offset against:

 

(i)         any equivalent over-award payments, and/or

 

(ii)        award wage increases since 29 May 1991 other than safety net, State Wage Case, and minimum rates adjustments.

 

The above clause will replace the offsetting clause inserted into awards pursuant to the principles determined in the State Wage Case 2001 decision.

 

3.          Delete the amounts in the clauses that appear in Column 1 of the following table and insert in lieu thereof the rates that appear in Column 3:

4.          Delete subclause (a) of clause 1.35, Vehicle - Expenses - Licences, and insert in lieu thereof the following:

 

(a)        Weekly Employees

 

Any employee required by an employer to provide at his own expense a bicycle shall be paid $8.00 per week extra, motor cycle $24.40 per week extra, motor car or utility under 2000cc capacity $90.09 per week extra plus 28c per kilometre, 2000cc and over $107.25 per week plus 28c per kilometre.

 

Casual Employees

 

Any employee required by an employer to provide at his own expense a motor car or utility under 2000cc capacity shall be paid 40c per kilometre, 2000cc and over 45c per kilometre.

 

5.          Delete the Wage Schedule from the Animal Welfare Section and insert in lieu thereof the following:
