1.  Title

 

This Award shall be known as the Storemen and Packers Grocery and Variety Warehouse (State) Superannuation Award.

 

2.  Definitions

 

(i)         In this award "the fund" can mean either the participating employers superannuation fund or the Labor Union Co-operative Retirement Fund (LUCRF).

 

(ii)        "Eligible Employee" - means a full-time employee who has completed one month’s continuous service or a casual employee who has accumulated 39 hours continuous service with the employer and is a member of, or eligible to be a member of, the National Union of Workers New South Wales Branch.

 

(iii)       "Ordinary Time Earnings" - means the eligible employees ordinary weekly or casual hourly rate of pay that includes only shift penalties, responsibility/leading hand rates, freezer allowances and productivity bonuses where applicable.

 

3.  Contributions

 

(i)         Each participating employer shall pay to the Trustee of the fund on behalf of each eligible employee who is a member of the Fund employed by that employer, contributions of three per cent of the employee’s ordinary weekly rate or casual hourly rate as at 1 July each year.

 

(ii)        When the employee becomes an eligible employee by having completed the required qualifying period of employment, the employer shall pay contributions for that qualifying period.

 

(iii)       Any employee who at the commencement of this award has already completed the appropriate eligibility period will be classified as an eligible employee.

 

(iv)       Provided that where an eligible employee has not joined the fund and refuses or fails to complete the election to so join, the employer shall not be bound to make contributions for that eligible employer.

(v)        There a participating employer’s fund is available, each eligible employee shall have the right of choice between either that participating employer’s fund or the Labor Union Co-operative Retirement Fund.

 

(vi)       An eligible employee’s election pursuant to this award shall be in writing in such terms as the participating employer’s fund or the Labor Union Co-operative Retirement Fund (LUCRF) may reasonably require.

 

(vii)      An eligible employee, having made an election pursuant to this award, shall not be entitled to change the election.

 

(viii)     A pro rata deduction shall be made from the weekly contribution made for each hour an employee is absent from work without pay.

 

(ix)       Such contribution will continue to be credited to the appropriate fund whilst the Union, its officials, and its members accept and honour in full the terms of the agreed variations to the work practices as documented in Matter No. 1601 of 1986 and Matter No. 462 of 1987.

 

(x)        Notation:  Employees covered by this award are also covered by the provisions of the Superannuation Guarantee Charge Act, 1992 (Cth.) and the Superannuation Guarantee (Administration) Act, 1992 (Cth.) and complimentary legislation.  Nothing in this notation, however, shall be used to reduce any benefits enjoyed by employees as at the date of making this award.

 

4.  Area, Incidence And Duration

 

(a)        This award rescinds and replaces the Storemen and Packers - Grocery and Variety Warehouse (State) Superannuation Award published 22 February 1991 (261 I.G. 426) and shall apply to all eligible employees being storemen and packers employed in Grocery and Variety Warehouses operated by Coles Myer Ltd., Franklins Limited, IGA Distribution Pty. Ltd., Woolworths Limited and Woolstar Pty. Ltd.

 

(a)        The changes made to the award pursuant to the Award Review pursuant to Section 19(6) of the Industrial Relations Act 1996 and Principle 26 of the Principles for Review of Awards made by the Industrial Relations Commission of New South Wales on 18 December 1998 (308 I.G. 307) and take effect on 18 June 2001.

 

(b)        This award remains in force until varied or rescinded, the period for which it was made having already expired.
