2.        Delete subclause (i) of clause 16, Holidays, and insert in lieu thereof the following:

 

(i)       The days on which holidays shall be observed are as follows: New Years Day, Australia Day, employees picnic day (to be held on such day as is mutually agreed between the council and the majority of all of its employees) Good Friday, Easter Saturday, Easter Sunday, Easter Monday, Anzac Day, King’s Birthday, Labour Day, Christmas Day, Boxing Day and/or proclaimed public holidays.

 

3.        Delete paragraph 19(1)(a) of clause 19, Carere's Leave and insert in lieu thereof the following:

 

(i)       Use of Sick Leave

 

(a)       An employee, other than a casual employee, with responsibilities in relation to a class of person set out in 19(1)(c) who needs the employee’s care and support, shall be entitled to use, in accordance with this subclause, any current or accrued sick leave entitlement, provided for at clause 18, Sick Leave of the award, for absences to provide care and support for such persons when they are ill, or who require care due to an unexpected emergency. Such leave may be taken for part of a single day.

 

4.        Delete paragraph 19(7)(1) of clause 19, Carer's Leave and insert in lieu thereof the following:

 

(vii)    Personal Carers Entitlement for casual employees

 

(1)      Subject to the evidentiary and notice requirements in 19(1)(b) and 19(1)(d) casual employees are entitled to not be available to attend work, or to leave work if they need to care for a person prescribed in subclause 19(1)(c) of this clause who are sick and require care and support, or who require care due to an unexpected emergency, or the birth of a child.

 

5.        Delete paragraph 20(vi)(a) of clause 20, Bereavement Leave, and insert in lieu thereof the following:

 

(vi)     Bereavement entitlements for casual employees

 

(a)       Subject to the evidentiary and notice requirements in 20(ii) casual employees are entitled to not be available to attend work, or to leave work upon the death in Australia of a person prescribed in subclause 19(1)(c) of clause 19, Carer's Leave.

 

6.        Insert after clause 20, Parental Leave, the following new clause 21, and renumber subsequent clauses accordingly:

 

21.  Paid Family and Domestic Violence Leave

 

(i)       Subdivision CA of Division 7 of Part 2-2 of the Fair Work Act 2009 (Cth) forms part of this Award.

 

Note:

 

       Division 2A of Part 6-3 of the Fair Work Act 2009 (Cth) extends federal entitlements to family and domestic leave to all employees/employers, including NSW local government employers/employees.

 

       Under the Fair Work Act 2009 (Cth) all employees can access 10 days of paid family and domestic violence leave during each 12 month period of employment. This includes part-time and casual employees. The entitlement does not accumulate from year to year. 

 

7.        Delete subclause (xi) of clause 31, Redundancy and Technological Change (formerly clause 30) and insert in lieu thereof the following

 

(xi)     The council shall, upon receipt of a request from an employee whose employment has been terminated, provide to the employee an "Employment Separation Certificate" in the form required by the Department of Social Services.

 

8.        Delete subclause (ii) of clause 34, Council Agreement (formerly clause 33) and insert in lieu thereof the following:

 

(ii)      The terms of any agreement reached between the parties shall substitute for the provisions of the award provided that:

 

(a)       the extent of the agreement shall be limited to the award's Clause 5, Rates of Pay, Clause 25 Travelling Allowances, Clause 11 Hours, Clause 13 Overtime, Clause 16 Public Holidays, Clause 12 Part time Employment and Clause 35 Performance Evaluation and Reward.

 

(b)      the agreement does not provide less than the entry level rates of pay

 

(c)       the agreement is consistent with the Industrial Relations Act NSW 1996 and current Award Making Principles

 

(d)      the agreement shall be processed in accordance with subclause (iii) of this Clause.

 

Provided further that, where the agreement proposes to vary award provisions other than those nominated in paragraph (a) above, the agreement shall be processed in accordance with the Review of the Principles for Approval of Enterprise Agreements 2021/2022 [2022] NSWIRComm 1005.

 

9.        Delete paragraph (iii)(d) of clause 34, Council Agreement and insert in lieu thereof the following:

 

(d)      the Council and the appropriate union(s) shall sign the agreement and a copy sent to Local Government NSW

 

10.      Delete Clause 39. Superannuation Fund Contributions (formerly clause 38), and insert in lieu thereof the following:

Subject to the provisions of the Industrial Relations Act 1996, a council shall make superannuation contributions to Vision Super and not to any other superannuation fund.

 

11.      Delete clause 40, Area, Incidence, and Duration (formerly clause 39), and insert in lieu thereof the following:

 

40.  Area, Incidence and Duration

 

This award shall take effect from the first pay period to commence on or after 7 December 1995 and shall remain in force for a period of twelve months.

 

This award was reviewed as part of the State Wage Case 2024 and all variations made pursuant to that review take effect from 1 September 2024.

 

This award shall apply to all councils (as defined in Clause 3) in Local Government within New South Wales (other than the Council of Sydney, the Council of the City of South Sydney and the Council of the city of Newcastle and also excluding the County of Yancowinna).

 

This award shall only apply to persons engaged in the industries and callings of makers, fitters, repairers and installers of electrical apparatus and installations, and persons assisting therein, or in running electrical plant.

 

Provided further that this award shall apply only to employees who are members of, or are eligible to be members of the Electrical Trades Union of Australia, New South Wales.

 

12.      Delete Part B, Monetary Rates and insert in lieu thereof the following:

The rates of pay and allowances in Part B, Monetary Rates take effect from the first pay period on or after 1 September 2024.

 

Note: The rates of pay and allowances in this award include the adjustments payable under the State Wage Case 2024.  These adjustments may offset any or both of:

 

i.         Any equivalent over award payments, and/or

 

ii.        Award wage increases other than State Wage Case adjustments.
