Title
This award will be known as the Crown Employees Wages Staff (Rates of Pay) Award 2024.
3.Â
No Extra Claims
The Industrial Relations Commission
recognises that the parties have provided an undertaking that other than as
provided for in the Industrial Relations Act 1996, there will be no
further claims/demands or proceedings instituted before the NSW Industrial
Relations Commission for extra or reduced wages, salaries, rates of pay,
allowances or conditions of employment with respect to the Employees covered by
the Award that take effect prior to the nominal expiry of the Award
unilaterally made by a party to the Award unless otherwise agreed by the
parties.
This undertaking does not prevent the
Parties from continuing collaborative discussions during the life of the Award
to deliver additional enhancements to remuneration and/or conditions of
employment, and to achieve additional industry wide and systemic efficiencies
and productivity improvements to the delivery of Government services to the
public. Changes to conditions or salaries may be jointly progressed and, if
agreed, an application to vary the Award may be made by consent prior to the
nominal expiry of the Award.
Parties are not prevented from commencing
any proceedings with respect to the interpretation, application or enforcement
of existing award provisions.
4.Â
Area, Incidence and Duration
The provisions of this Award will apply to
officers, departmental temporary employees and casual employees employed by the
Government of NSW under the Government
Sector Employment Act 2013 in classifications covered by the provisions of
the awards and agreements set out at Schedule "A" of this Award and
will not apply to employees covered by the Taronga Conservation Society
Australia Wages Employees’ Award.
This award rescinds and replaces the Crown
Employees Wages Staff (Rates of Pay) Award 2022 published 8 December 2023 (395
I.G 1529) and all variances. This award will come into effect from 1 July 2024
and remains in force for three years.
5.Â
Wages and Allowances
(i)Â Â Â Â Â Â Â Wage rates and allowances are set out in
Part B.
(ii)Â Â Â Â Â The
wage increases referred to in paragraph 5(i) of this
award will only be paid to those employees who are employed as at the date of
the making of this award.
(iii)Â Â Â Â The
increases referred to in paragraph 5(i) of this award
do not apply to expense related allowances as set out in Schedule D of Part B.
6.Â
Facilitative Arrangement
(i)Â Â Â Â Â Â Â The purpose of this arrangement is to
facilitate agency level bargaining on classification structures.
(ii)Â Â Â Â Â Specifically,
the industrial parties are committed to the introduction of classification
structures which provide a career path for trades and wages staff, recognise
the importance of training and provide for appropriate progression. These
arrangements are to be developed on an agency by agency
basis. The parties at the sector-wide level are to establish minimum standards
to include in the Crown Employees Wages Staff Rates of Pay Award.
(iii)Â Â Â Â Further
achievement of agency level outcomes should be achieved through:
(a)Â Â Â Â Â Â Each
agency that has not implemented a skills based
classification structure is to establish a joint union and management
committee.
(b)Â Â Â Â Â Â Where
applicable, the Industrial Relations Secretary and Unions NSW may seek
quarterly progress reports on agency level committee negotiations.
(c)Â Â Â Â Â Â The
committee is to consider the existing arrangements in an agency, review the
arrangements achieved already in other agencies, and establish negotiation
parameters including:
(1)Â Â Â Â Â Â the
development of level descriptors;
(2)Â Â Â Â Â Â identification
of structured training for the purposes of the level descriptors; and
(3)Â Â Â Â Â Â translation
of existing staff into any new structure.
(d)Â Â Â Â Â Â It
is anticipated that agency level committees will complete their negotiations by
the making of appropriate agency level industrial instruments. Such agency
level arrangements will be reviewed by Unions NSW and the Industrial Relations
Secretary to establish minimum standards in the sector-wide Wages Staff Rates
of Pay Award.
(e)Â Â Â Â Â Â The
usual Dispute Resolution procedures as set out in clause 10 will be followed by
the industrial parties in the context of these negotiations.
(f)Â Â Â Â Â Â Â Should
the agency level bargaining not be likely to be settled by the wages unions
claim for a particular agency, then either party may seek the assistance of the
Industrial Relations Commission of NSW through either conciliation and/or
arbitration.
7.Â
Salary Packaging Arrangements, Including Salary Sacrifice to
Superannuation
(i)Â Â Â Â Â Â Â The entitlement to salary package in
accordance with this clause is available to:
(a)Â Â Â Â Â Â permanent
full-time and part-time employees;
(b)Â Â Â Â Â Â temporary
employees, subject to the Department or agency’s convenience; and
(c)Â Â Â Â Â Â casual
employees, subject to the Department or agency’s convenience, and limited to
salary sacrifice to superannuation in accordance with subclause (vii).
(ii)Â Â Â Â Â For
the purposes of this clause:
(a)Â Â Â Â Â Â "salary"
means the salary or rate of pay prescribed for the employee's classification by
clause 4, Wages and Allowances, Part B of this Award, and any other payment
that can be salary packaged in accordance with Australian taxation law.
(b)Â Â Â Â Â Â "post
compulsory deduction salary" means the amount of salary available to be
packaged after payroll deductions required by legislation or order have been taken into account. Such payroll deductions may include, but
are not limited to, taxes, compulsory superannuation payments, HECS payments,
child support payments, and judgement debtor/garnishee orders.
(iii)Â Â Â Â By
mutual agreement with the Industrial Relations Secretary, an employee may elect
to package a part or all of their post compulsory
deduction salary in order to obtain:
(a)Â Â Â Â Â Â a
benefit or benefits selected from those approved by the Industrial Relations
Secretary; and
(b)Â Â Â Â Â Â an
amount equal to the difference between the employee’s salary, and the amount
specified by the Industrial Relations Secretary for the benefit provided to or
in respect of the employee in accordance with such agreement.
(iv)Â Â Â Â An
election to salary package must be made prior to the commencement of the period
of service to which the earnings relate.
(v)Â Â Â Â Â Â The
agreement will be known as a Salary Packaging Agreement.
(vi)Â Â Â Â Except
in accordance with subclause (vii), a Salary Packaging Agreement will be
recorded in writing and will be for a period of time
as mutually agreed between the employee and the Industrial Relations Secretary
at the time of signing the Salary Packaging Agreement.
(vii)Â Â Â Where
an employee makes an election to sacrifice a part or all of
their post compulsory deduction salary as additional employer superannuation
contributions, the employee may elect to have the amount sacrificed:
(a)Â Â Â Â Â Â paid
into the superannuation fund established under the First State Superannuation Act 1992; or
(b)Â Â Â Â Â Â where
the employer is making compulsory employer superannuation contributions to
another complying superannuation fund, paid into the same complying fund; or
(c)Â Â Â Â Â Â subject
to the Department or agency’s agreement, paid into another complying
superannuation fund.
(viii)Â Â Where
the employee makes an election to salary sacrifice, the employer will pay the
amount of post compulsory deduction salary, the subject of election, to the
relevant superannuation fund.
(ix)Â Â Â Â Where
the employee makes an election to salary package and where the employee is a
member of a superannuation scheme established under the:
(a)Â Â Â Â Â Â Police Regulation (Superannuation) Act 1906;
(b)Â Â Â Â Â Â Superannuation Act 1916;
(c)Â Â Â Â Â Â State Authorities Superannuation Act
1987; or
(d)Â Â Â Â Â Â State Authorities Non-contributory
Superannuation Act 1987,
the
employee’s Department or agency must ensure that the employee’s superable
salary for the purposes of the above Acts, as notified to the SAS Trustee
Corporation, is calculated as if the Salary Packaging Agreement had not been entered into.
(x)Â Â Â Â Â Â Where
the employee makes an election to salary package, and where the employee is a
member of a superannuation fund other than a fund established under legislation
listed in subclause (ix) of this clause, the employee’s Department or agency
must continue to base contributions to that fund on the salary payable as if
the Salary Packaging Agreement had not been entered into. This clause applies even though the
superannuation contributions made by the Department or agency may be in excess of superannuation guarantee requirements after the
salary packaging is implemented.
(xi)Â Â Â Â Where
the employee makes an election to salary package:
(a)Â Â Â Â Â Â subject
to Australian Taxation law, the amount of salary packaged will reduce the
salary subject to appropriate PAYG taxation deductions by the amount packaged;
and
(b)Â Â Â Â Â Â any
allowance, penalty rate, payment for unused leave entitlements, weekly worker’s
compensation or other payment, other than any payments for leave taken in
service, to which an employee is entitled under this Award or any applicable
Award, Act or statute which is expressed to be determined by reference to the
employee’s rate of pay, will be calculated by reference to the rate of pay
which would have applied to the employee under clause 4, Wages and Allowances,
or Part B, of this Award if the Salary Packaging Agreement had not been entered
into.
(xii)Â Â Â The
Industrial Relations Secretary may vary the range and type of benefits
available from time to time following discussion with the Unions NSW and
unions. Such variations will apply to
any existing or future Salary Packaging Agreement from date of such variation.
(xiii)Â Â The
Industrial Relations Secretary will determine from time to time the value of
the benefits provided following discussion with the Unions NSW and unions. Such variations will apply to any existing or
future Salary Packaging Agreement from the date of such variation. In this circumstance, the employee may elect
to terminate the Salary Packaging Agreement.
8.Â
Carer’s Leave
(i)Â Â Â Â Â Â Â Use of Sick Leave:
(a)Â Â Â Â Â Â An
employee, other than a casual employee, with responsibilities in relation to a
class of person set out in subparagraph 8(i)(c)(2)
will be entitled to use, in accordance with this subclause, any sick leave
accruing from 1 January 1998 for absences to provide care and support for such
persons when they are ill. Such leave may be taken for part of a single day.
(b)Â Â Â Â Â Â The
employee will, if required, establish either by production of a medical
certificate or statutory declaration, the illness of the person concerned.
(c)Â Â Â Â Â Â The
entitlement to use sick leave in accordance with this subclause is subject to:
(1)Â Â Â Â Â Â the
employee being responsible for the care of the person concerned; and
(2)Â Â Â Â Â Â the
person concerned being:
(i)Â Â Â Â Â Â Â a spouse of the employee; or
(ii)Â Â Â Â Â a
de facto spouse, who, in relation to the employee, is a person of the opposite
sex to the employee who lives with the employee as the husband or wife of the
employee on a bona fide domestic basis although not legally married to that
person; or
(iii)Â Â Â Â a
child or an adult child (including an adopted child, a step
child, a foster child or an ex nuptial child), parent (including a
foster parent or legal guardian), grandparent, grandchild or sibling of the
employee or of the spouse or de facto spouse of the employee; or
(iv)Â Â Â Â a
same sex partner who lives with the employee as the de facto partner of that
employee on a bona fide domestic basis; or
(v)Â Â Â Â Â Â a
relative of the employee who is a member of the same household, where for the
purposes of this subparagraph:
"relative"
means a person related by blood, marriage, affinity or Aboriginal kinship structures;
"affinity"
means a relationship that one spouse because of marriage has to the relatives
of the other; and
"household"
means a family group living in the same domestic dwelling.
(d)Â Â Â Â Â Â An
employee will, wherever practicable, give the employer notice prior to the
absence of the intention to take leave, the name of the person requiring care
and that person’s relationship to the employee, the reasons for taking such
leave and the estimated length of absence. If it is not practicable for the
employee to give prior notice of absence, the employee will notify the employer
by telephone of such absence at the first opportunity on the day of the
absence.
(ii)Â Â Â Â Â Unpaid
Leave for Family Purpose: An employee may elect, with the consent of the
employer, to take unpaid leave for the purpose of providing care and support to
a member of a class of person set out in subparagraph 8(i)(c)(2)
who is ill.
(iii)Â Â Â Â Annual
Leave:
(a)Â Â Â Â Â Â An
employee may elect, with the consent of the employer, subject to annual leave
provisions applicable to employees covered by this award, to take annual leave
not exceeding ten days in single day periods or part thereof, in any calendar
year at a time or times agreed by the parties.
(b)Â Â Â Â Â Â Access
to annual leave, as prescribed in paragraph (iii)(a) above, will be exclusive
of any shutdown period provided for elsewhere under the industrial instruments
covered by this award.
(c)Â Â Â Â Â Â Where
applicable, an employee and employer may agree to defer payment of annual leave
loading in respect of single day absences, until at least five consecutive
annual leave days are taken.
(iv)Â Â Â Â Time
Off in Lieu of Payment for Overtime:
(a)Â Â Â Â Â Â An
employee may elect, with the consent of the employer, to take time off in lieu
of payment for overtime at a time or times agreed with the employer within 12
months of the said election.
(b)Â Â Â Â Â Â Overtime
taken as time off during ordinary time hours will be taken at the ordinary time
rate, that is, an hour for each hour worked.
(c)Â Â Â Â Â Â If,
having elected to take time as leave in accordance with paragraph (iv)(a)
above, the leave is not taken for whatever reason, payment for time accrued at
overtime rates will be made at the expiry of the 12 month
period or on termination.
(d)Â Â Â Â Â Â Where
no election is made in accordance with the said paragraph (iv)(a), the employee
will be paid overtime rates in accordance with the award.
(v)Â Â Â Â Â Â Make-up
Time:
(a)Â Â Â Â Â Â An
employee may elect, with the consent of the employer, to work "make-up
time", under which the employee takes time off ordinary hours, and works
those hours at a later time, during the spread of
ordinary hours provided in the award, at the ordinary rate of pay.
(vi)Â Â Â Â Bereavement
Leave:
(a)Â Â Â Â Â Â An
employee other than a casual employee will be entitled to up to two days
Bereavement Leave without deduction of pay on each occasion of the death of a
member of a class of person set out in subparagraph 8(i)(c)(2)
above.
(b)Â Â Â Â Â Â The
employee must notify the employer as soon as practicable of the intention to
take Bereavement Leave and will, if required by the employer, provide to the
satisfaction of the employer proof of death.
(c)Â Â Â Â Â Â Bereavement
Leave will be available to the employee in respect of the death of a person in
relation to whom the employee could have utilised Carer’s Leave as prescribed
by this clause. The employee need not have been responsible for the care of the
person concerned to be eligible for Bereavement Leave as prescribed in this
subclause.
(d)Â Â Â Â Â Â An
employee will not be entitled to Bereavement Leave under this clause during any
period in respect of which the employee has been granted other leave.
(e)Â Â Â Â Â Â Bereavement
leave may be taken in conjunction with any other leave available to employees.
Where such other available leave is to be taken in conjunction with Bereavement
Leave, consideration will be given to the circumstances of the employee and the
reasonable operational requirements of the employer.
9.Â
Anti-Discrimination
(i)Â Â Â Â Â Â Â It is the intention of the parties bound
by this award to seek to achieve the object in section 3(f) of the Industrial Relations Act 1996 to prevent
and eliminate discrimination in the workplace.Â
This includes discrimination on the grounds of race, sex, marital
status, disability, homosexuality, transgender identity, age and
responsibilities as a carer.
(ii)Â Â Â Â Â It
follows that in fulfilling their obligations under the dispute resolution
procedure prescribed by this award the parties have obligations to take all
reasonable steps to ensure that the operation of the provisions of this award are not directly or indirectly discriminatory in their
effects. It will be consistent with the
fulfilment of these obligations for the parties to make application to vary any
provision of the award that, by its terms or operation, has a direct or
indirect discriminatory effect.
(iii)Â Â Â Â Under
the Anti-Discrimination Act 1977, it
is unlawful to victimise an employee because the employee has made or may make
or has been involved in a complaint of unlawful discrimination or harassment.
(iv)Â Â Â Â Nothing
in this clause is to be taken to affect:
(a)Â Â Â Â Â Â any
conduct or act which is specifically exempted from anti-discrimination legislation;
(b)Â Â Â Â Â Â offering
or providing junior rates of pay to persons under 21 years of age;
(c)Â Â Â Â Â Â any
act or practice of a body established to propagate religion which is exempted
under section 56(d) of the Anti-Discrimination
Act 1977;
(d)Â Â Â Â Â Â a
party to this award from pursuing matters of unlawful discrimination in any
State or federal jurisdiction.
(v)Â Â Â Â Â Â This
clause does not create legal rights or obligations in addition to those imposed
upon the parties by the legislation referred to in this clause.
NOTES
Employers
and employees may also be subject to Commonwealth anti-discrimination
legislation. Section 56(d) of the Anti-Discrimination
Act 1977 provides:
"Nothing
in the Act affects .... any other act or practice of a body established to
propagate religion that conforms to the doctrines of that religion or is
necessary to avoid injury to the religious susceptibilities of the adherents of
that religion."
10.Â
Dispute Resolution Procedures
Subject to the provisions of the Industrial Relations Act 1996, all
disputes relating to the provisions of this Award will be dealt with in the
following manner so as to ensure the orderly
settlement of the matters in question:
(i)Â Â Â Â Â Â Â Any grievance or dispute which arises
will, where possible, be settled by discussion on the job between the staff
member and the immediate supervisor.
(ii)Â Â Â Â Â If
the matter is not resolved at this level, it will be further discussed between
the staff member and the union delegate/employees
representative and the employer.
(iii)Â Â Â Â If
no agreement is reached within a reasonable time period,
the union or the employees representative will discuss
the matter with the staff member’s nominated representative.
(iv)Â Â Â Â While
the foregoing procedure is being followed, work will continue normally. No part
will be prejudiced as to the final settlement by the continuance of work in
accordance with this subclause.
(v)Â Â Â Â Â Â Should
the matter still not be resolved within a reasonable time
period, it may be referred to the Industrial Relations Commission of New
South Wales for settlement by either party.
11.Â
Deduction of Union Membership Fees
(i)Â Â Â Â Â Â Â The union will provide the employer with
a schedule setting out union fortnightly membership fees payable by members of
the union in accordance with the union’s rules.
(ii)Â Â Â Â Â The
union will advise the employer of any change to the amount of fortnightly
membership fees made under its rules. Any variation to the schedule of union
fortnightly membership fees payable will be provided to the employer at least
one month in advance of the variation taking effect.
(iii)Â Â Â Â Subject
to (i) and (ii) above, the employer will deduct union
fortnightly membership fees from the pay of any employee who is a member of the
union in accordance with the union’s rules, provided that the employee has
authorised the employer to make such deductions.
(iv)Â Â Â Â Monies
so deducted from employee’s pay will be forwarded regularly to the union
together with the necessary information to enable the union to reconcile and
credit subscriptions to employees’ union membership accounts.
(v)Â Â Â Â Â Â Unless
other arrangements are agreed to by the employer and the union, all union
membership fees will be deducted on a fortnightly basis.
(vi)Â Â Â Â Where
an employee has already authorised the deduction of union membership fees from
his or her pay prior to this clause taking effect, nothing in this clause will
be read as requiring the employee to make a fresh authorisation in order for such deductions to continue.

(ii)Â Â Â Â Â An
apprentice who has passed the prescribed annual technical college examinations
for the preceding year will be paid an additional weekly allowance of $1.30.
Payment of this allowance is subject to a satisfactory report as to conduct,
punctuality and workshop progress by his/her supervisor. Such additional
allowance will be payable from the beginning of the first pay period commencing
in January following the examinations.
(iii)Â Â Â Â An
apprentice who, in any year fails to complete a subject or subjects but
completes them concurrently with passing the succeeding year’s examinations,
will be deemed to qualify for payment of the allowance specified in this
subclause for the succeeding year as if he had not initially failed to complete
the subject or subjects.
(iv)Â Â Â Â All
wages will be paid on a weekly basis: It will be an implied term of any
contract of apprenticeship that the employing Authority may deduct from the
weekly wage of an apprentice an amount proportionate to the time lost by an
apprentice for any reason not considered satisfactory to the employing
Authority.
(v)Â Â Â Â Â Â Apprentice
patternmakers will be paid the sum of $1.30 per week in addition to the wage
rates prescribed for apprentices in subclause (i).
