PART A
1. Title
This award is known as the Psychiatry Staff Specialists
Attraction and Retention (State) Interim Award 2025.
2. Parties
The parties to this award are:
(a) the Secretary of the Ministry of
Health exercising employer functions on behalf of the Government of New South
Wales; and
(b) the Australian Salaried Medical Officers’
Federation (New South Wales).
3. Area, Incidence and
Duration
3.1 This award
commences on 3 October 2025 and shall continue in force for a period of 12
months, unless varied or rescinded in accordance with section 17 of the
Industrial Relations Act 1996 (NSW).
3.2 This award
applies to Psychiatrist Staff Specialists, being employees who are:
(a) a Staff Specialist within the
meaning of clause 2 of the Staff Specialist (State) Award 2022, and
(b) a Fellow of the
Royal Australian and New Zealand College of Psychiatrists (RANZCP) employed by
the Employer to work as a psychiatrist.
3.3 This award does
not rescind or replace the Staff Specialists (State) Award 2022 or the
Health Secretary’s Determination No 52 of 2024, but rather, provides an
additional term and condition to Psychiatry Staff Specialists during the
nominal term of this award.
4. Definitions
4.1 “Employer” means
the Secretary of the Ministry of Health exercising employer functions on behalf
of the Government of New South Wales.
4.2 “Level 1 Private
Practice Allowance” means the allowance provided for at clause 2(b)(i)(2) of
the Staff Specialist Determination 2015.
4.3 “Salary” means
the salary set out in Part B of Schedule 1 of the Staff Specialist (State)
Award 2022.
4.4 “Special
Allowance” means the Special Allowance of 17.4 % of a Staff Specialist’s Salary
as set out in clause 4 of NSW Health Circular 90/39, as incorporated at clause
2(a)(ii) of the Staff Specialist Determination 2015.
4.5 “Staff
Specialists (State) Award 2022” means the Staff Specialists (State)
Award 2022 (Code 470), as varied on 1 July 2023.
5. Issue Resolution
5.1 Any grievances
and disputes arising between the parties or between the Employer and any
employees covered under this award are dealt with in accordance with the Issue
Resolution procedure prescribed under the Staff
Specialists (State) Award 2022.
6. Psychiatry
Attraction and Retention Allowance
6.1 From the first
full pay period on or after 3 October 2025, for a period of 12 months, a
Psychiatry Staff Specialist will be paid the Psychiatry Attraction and
Retention Allowance.
6.2 The Psychiatry
Attraction and Retention Allowance is a payment (the current FTE rate is
prescribed for convenience in Part B of this Award) calculated as 10% of the
sum of the Psychiatry Staff Specialist’s:
(a) Salary;
(b) Special Allowance; and
(c) the Level 1
Private Practice Allowance.
6.3 The Psychiatry
Attraction and Retention Allowance will be paid to Psychiatry Staff Specialists
during their usual pay period each fortnight.
6.4 The Psychiatry Attraction and Retention
Allowance will be payable during periods of paid absences on approved leave but
will not be paid where the monetary value of leave is paid upon termination.
6.5 The Psychiatry Attraction and
Retention Allowance is to be considered as salary for the purposes of
superannuation.
