VARIATION
1. Delete the title
of the award, of the award published 1 October 2025 (398 I.G. 239) and insert
in lieu thereof the following:
Kindergartens and Child Care Centres, &c. (State)
Award
2. Delete from the
arrangement, clause 36, Exemptions and clause 38, Leave Reserved, and renumber
existing clauses accordingly.
3. Delete the
year "2024" in paragraph (i)(c) of clause
9, Wages, and insert in lieu thereof "2025".
4. Delete the word
"Queen's" in subclause (i)
of clause 19, Public Holidays, and insert in lieu thereof the word
"King's".
5. Delete clause
36, Exemptions and clause 38, Leave Reserved from the award and renumber
subsequent clauses accordingly.
6. Delete clause
37, Area, Incidence and Duration, and in lieu thereof the following:

and Duration
This award is made following a variation on adoption of
National Decisions under section 52 of the Industrial Relations Act 1996 as
part of the State Wage Case 2025, and rescinds and
replaces the Kindergartens and Child Care Centres (State) Award as made on 4
August 2025 (see State Wage Case 2024 – Review of Minimum Rates Awards (No
2) [2025] NSWIRComm 1059).
It will apply to all persons of the classes herein provided
for within the jurisdiction of the Kindergartens, &c. (State) Industrial
Committee.
This award will take effect on and from 1 July 2025 and
remain in force until 30 June 2026.
7. Delete Part B,
Monetary Rates, and insert in lieu thereof the following:

in Annexure B to the orders made in the State Wage Case 2024.
8. This variation
will take effect on and from the first full pay period commencing on or after I
July 2025.
