AWARD

 

1.        Delete clauses 1-3 of the award published 3 June 2022 (392 I.G. 21) and insert in lieu thereof following:

 

1.  Title

 

This Award will be known as the Crown Employees (Department of Primary Industries and Regional Development) Fisheries Employees Award.

 

2.  Parties to the Award

 

This Award is binding upon the Industrial Relations Secretary and the Public Service Association and Professional Officers Association Amalgamated Union of New South Wales.

 

3.  Definitions

 

"AFMA" means the Australian Fisheries Management Authority

 

"Association" or "Union" means the Public Service Association and Professional Officers Association Amalgamated Union of New South Wales.

 

"Department" means the Department of Primary Industries and Regional Development as established under Schedule 1, Part 1 of the Government Sector Employment Act 2013.

 

"Employees" means and includes all persons employed on an ongoing full time, ongoing part time or temporary basis under the provisions of the Government Sector Employment Act 2013, who, on the operative date or during the period of operation of this award, are assigned to a role to perform the duties and roles of the former NSW Fisheries within the Department, except for Fisheries Technicians and Hatcheries Staff to which the Crown Employees (Department of Primary Industries and Regional Development) Technical Staff Award 2025 applies.

 

"Employer" means the Industrial Relations Secretary, or as otherwise defined in s 49(1) of the Government Sector Employment Act 2013.

 

"FFPP" means the first full pay period.

 

"Secretary" means the Secretary of the Department of Primary Industries and Regional Development established under the Government Sector Employment Act 2013.

 

2.        Delete paragraphs (b) and (c) of subclause (i) of clause 4, Salaries.

 

3.        Delete the words "Managers and Assistant Managers at hatcheries" in subclause (a) and the entire subclause (c) of clause 6, Hours of Work and Working Hours Arrangements.

 

4.        Delete the second paragraph of subclause (b) and delete the words "or located at Trout Hatcheries" in subclause (c) of clause 7, Housing.

 

5.        Delete the year "2021" and insert in lieu thereof "2024" in subclause (a) of clause 15, Area, Incidence and Duration.

 

6.        Delete subclauses (b) and (c) of clause 15, Area, Incidence and Duration, and insert in lieu thereof the following:

 

(b)       This Award will apply to all employees assigned to roles that can be identified as a responsibility of the former NSW Fisheries in the Department of Regional NSW, except for Fisheries Technicians and Hatchery Staff to which the Crown Employees (Department of Primary Industries and Regional Development) Technical Staff Award 2025 applies.

 

(c)       The changes made to the Award take effect on and from [date].

 

7.        Delete Part B, Monetary Rates and insert in lieu thereof the following:

8.        Delete Attachment A in its entirety and rename existing Attachment B to read as Attachment A.
