INDUSTRIAL RELATIONS COMMISSION OF NEW SOUTH WALES

 

Notice of Award Review pursuant to section 19 of the Industrial Relations Act 1996.

 

(No. IRC 931 of 2001)

 

Before Mr Deputy President Sams

29 May 2001

 

Reviewed award

 

1.          Delete clause 3, Scope and Parties Bound, of the award published 28 June 1989 (252 I.G. 1049) and insert in lieu thereof the following:

 

3.   Scope and Parties Bound

 

This award shall be binding on the Federated Clerks' Union of Australia, New South Wales Branch and the Employer.

 

The award shall apply to employees who are not eligible to receive contributions from their employer pursuant to the Superannuation Guarantee Charge legislation.

 

2.          Delete the definition of "Member" appearing in clause 4, Definitions, and insert in lieu thereof the following:

 

"Employee": means a full-time, part-time or casual employee.

 

"Basic Earnings": means the award rate for the work performed plus any shift loading payable under the award.

 

3.          Replace the reference to "member" through out the award with the term "employee".

 

4.          Delete subclause (a) of clause 5, Nature of Benefits, and insert in lieu thereof the following:

 

(a)

 

(i)         The employer shall, in respect of each employee employed on a full-time, part-time or casual basis, pay contributions into one of the Superannuation schemes named in schedule A at the rate of 3% of the employees Basic Earnings.

 

(ii)        The employer shall in respect of each employee employed on a part-time or casual basis (provided that such employee has worked shifts equivalent to 20 full days work within the 13 weeks prior to the employees application pursuant to subclause (d) of this clause and with the effect only from the time when this requirement is met) pay contributions into one of the employees basic earnings. Basic earnings means the award rate for part-time or casual employees whichever is appropriate plus any allowances payable under the award.

 

5.          Insert after subclause (d) of clause 8, Area, Incidence and Duration, the following new subclause (e):

 

(e)        This award was reviewed pursuant to section 19 of the Industrial Relations Act 1996 on 29 May 2001.

 

6.          Insert after Item 2 of Schedule A, the following new Item 3:

7.          This variation shall take effect on and from 29 May 2001.
