VARIATION
1. Insert after
subclause 3.3 of clause 3, Parties to the Award, of the award published 18 May
2001 (324 I.G. 1048), the following new subclause:
3.4 "Readymix
Holdings Pty Limited".
2. Insert after
subclause 37.11 of clause 37, Redundancy the following a new subclause:
37.12 Transmission of
Business
37.12.1 Where
a business is before or after the date of this award transmitted from CSR to
Readymix Holdings Pty Limited ("Readymix"), and an employee who at
the time of such transmission was an employee of CSR is offered employment with
Readymix on a continuous service basis and on no less favourable terms and
conditions of employment, the employee is not entitled to receive the benefit
of subclause 37.11 by virtue of the transmission.
37.12.2 Where
an employee of CSR accepts an offer of employment with Readymix pursuant to
subclause 37.12.1:
(a) the continuity
of the employee's employment shall be deemed not to have broken by such
transmission;
(b) the period of
service with CSR is taken to be a period of service with Readymix; and
(c) no payment in
respect of accrued leave entitlements shall be payable to the employee.
3. This
variation shall come into operation from 31 January 2003 and shall remain in
force for a period of 6 months.
