VARIATION

 

1.          Insert in numerical order in the Arrangement of the award published 18 January 2002 (330 I.G. 947), the following new clause and subject matter:

 

20.  Transmission of Business

 

2.          Insert after clause 19, Remuneration and Adjustment Stages, the following new clause 20, Transmission of Business.

 

20.  Transmission of Business

 

20.1      Where a business is before or after the date of this award transmitted from CSR to another employer ("Transmittee"), and an employee who at the time of such transmission was an employee of CSR is offered employment with the Transmittee on a continuous service basis and on no less favourable terms and conditions of employment, the employee is not entitled to receive any amount by way of severance pay which might otherwise be payable under the Cement Mixers and Concrete Workers, Central Batch Plants (State) Award.

 

20.2      Where an employee of CSR accepts an offer of employment with the Transmittee pursuant to subclause 20.1:

 

(a)        the continuity of the employee's employment shall be deemed not to have been broken by such transmission;

 

(b)        the period of service with CSR is taken to be a period of service with the Transmittee; and

 

(c)        no payment in respect of accrued leave entitlements shall be payable to the employee.

 

3.          This variation shall come into operation from 24 December 2002 and shall remain in force for a period of six months.
