AWARD

 

PART 1

 

APPLICATION AND OPERATION OF AWARD

 

1.  Award Title

 

This Award shall be known as The Pan Pharmaceuticals Group Redundancy Award 2003.

 

2.  Parties Bound

 

This Award binds:

 

(a)        The Australian Workers' Union, New South Wales (the Union);

 

(b)        Pan Pharmaceuticals Ltd (in liquidation).

 

Pan Laboratories (Australia) Pty Ltd (in liquidation).

 

Pan Pharmaceuticals Export Pty Ltd (Administrators Appointed).

 

Pan Pharmaceuticals Services Pty Ltd (Administrators Appointed).

 

Pan Pharmaceuticals Technologies Pty Ltd (Administrators Appointed) (together described as the Companies).

 

3.  Application

 

This Award applies to employees of the Companies who are employed in classifications under the Clerical and Administrative Employees (State) Award and the Drug Factories (State) Award (together described as the Existing Awards).

 

4.  Commencement and Operation

 

This Award shall commence to operate on 2 October 2003 and shall remain in force for 1 year (the Nominal Term).

 

5.  Additional Redundancy Benefits

 

On termination of employment for reason of redundancy, the employees covered by this award will be entitled to the following benefits in addition to notice and redundancy benefits payable under the Existing Awards:

 

Employees who have completed less than one

 

year of service

1 week's pay

Employees who have completed more than

1 week's pay for each completed year

one year of service

of service

All employees

Outplacement services to a maximum

 

value of $1,000 for each employee

 

 

6.  Resolution of Disputes

 

Dispute resolution procedures will be in accordance with clause 41 of the Clerical and Administrative Employees (State) Award or clause 40 of the Drug Factories (State) Award, whichever is applicable to the employees who are the subject of the dispute.
