INDUSTRIAL RELATIONS COMMISSION OF NEW SOUTH WALES

 

Review of Award pursuant to Section 19 of the Industrial Relations Act 1996.

 

(Nos. IRC 5588 of 2003)

 

Before The Honourable Mr Deputy President Harrison

REVIEWED AWARD

 

1.          Renumber clause 20, Duration of Award in the Contents as clause 21, and renumber clause 21, Anti-Discrimination as clause 20, of the award published 18 August 2000 (317 I.G. 1030), as follows:

2.          Delete subclause 7.2 of clause 7, Contract of Employment, and insert in lieu thereof the following:

 

7.2        Except in relation to persons employed for a specified period and casual employees, employment shall be terminated by not less than one month’s notice (or such lesser period as may be mutually agreed) given by either party or by the payment or forfeiture of a month’s salary, as the case may be, except where services are summarily terminated for malingering, neglect of duty or misconduct.

 

3.          Delete subclause 11.1 of clause 11, Holidays and insert in lieu thereof the following:

 

11.1      An employee shall be entitled to the following public holidays without loss of pay: New Year’s Day, Australia Day, Good Friday, Easter Saturday, Easter Monday, ANZAC Day, Queen’s Birthday, Labor Day, Christmas Day and Boxing Day or such other days as are generally observed in the locality as a substitute for any of the said days and, in addition thereto, any special days appointed by proclamation as public holidays throughout the State.

 

4.          Delete clause 14, Sick Leave, and insert in lieu thereof the following:

 

14.  Sick Leave

 

An employee absent from duty on account of personal ill-health or injury due to any cause shall be entitled to payment of sick leave to the same extent and upon the same conditions as are applicable from time to time to the majority of employees employed in the particular establishment in which the employee is employed. Provided that the minimum quantum of sick leave entitlement shall be ten days per annum, cumulative to ten years sick leave entitlements.

 

5.          Delete subclause 18.2 of clause 18, Grievance and Disputes Procedure, and insert in lieu thereof the following:

 

18.2      A meeting between the employee and employer shall be held within five working days of notification. The meeting will be with the employee’s supervisor, unless the substance of the grievance suggests otherwise.

 

6.          Delete paragraph (1) in clause 20, Anti-Discrimination and Harassment, and insert in lieu thereof the following:

 

 

NOTES -

 

(1)        Employers and employees may also be subject to Commonwealth anti-discrimination legislation which may prohibit unlawful discrimination on other ground than those identified in subclause 20.1 above.

 

7.          Insert a new paragraph in clause 21, Duration of Award.

 

The changes made to the award pursuant to the Award Review pursuant to section 19(6) of the Industrial Relations Act 1996 and Principle 26 of the Principles for Review of Awards made by the Industrial Relations Commission of NSW on 28 April 1999 (310 I.G. 359) and take effect on 10 December 2003.
