SAWMILLERS, &c., (STATE) AWARD

 

INDUSTRIAL RELATIONS COMMISSION OF NEW SOUTH WALES

 

Review of Award pursuant to Section 19 of the Industrial Relations Act 1996.

 

(No. IRC 5716 of 2003)

 

 

REVIEWED AWARD

 

1.          Delete subclause (1) of clause 3, Anti-Discrimination of the award published 12 June 2001 (325 I.G. 480) and insert in lieu thereof the following:

 

(1)        It is the intention of the parties bound by this award to seek to achieve the object in section 3(f) of the Industrial Relations Act 1996 to prevent and eliminate discrimination in the workplace. This includes discrimination on the ground of race, sex, marital status, disability, homosexuality, transgender identity and age and carer’s responsibilities.

 

2.          Delete subparagraph 13.7.2 (b), of clause 13, Employment Categories and insert in lieu thereof the following:

 

13.7.2 (b)         The provisions of any statute, award or regulations relating to the attendance of apprentices at TAFE or other Registered Training Organisation during ordinary working hours shall not be deemed to be inconsistent with this award.

 

3.          Delete subparagraph 27.7.2 (b), of clause 27, Hours -Day Work and insert in lieu thereof the following:

 

27.7.2 (b)         An apprentice who is required to attend TAFE or other Registered Training Organisation on a rostered day off shall be entitled to a substitute day as soon as practicable following the attendance at TAFE or other Registered Training Organisation.

 

4.          Delete the title of clause 36, Personal/Carer's Leave - August 1996, and insert lieu thereof the following:

5.          Insert after subclause (ii) of clause 47, Area, Incidence and Duration, the following new subclauses:

 

(iii)       The changes made to the award pursuant to the Award Review pursuant to section 19(6) of the Industrial Relations Act, 1996 and Principle 26 of the Principles for Review of Awards made by the Industrial Relations Commission of NSW on 28 April 1999 (310 I.G. 359) and take effect on 6 February 2004.

 

(iv)       This award remains in force until varied or rescinded, the period for which it was made already having expired.

 

6.          Delete the words "Industrial and Commercial Training Act 1989" wherever appearing in clause 5, Definitions of Appendix F and insert in lieu thereof the words "Apprenticeship and Traineeship Act 2001".
