REVIEWED AWARD
1. Renumber
clause 39A, Deduction of Union Membership Fees to read as clause 40 in the
Arrangement of the award published 3 November 2000 (319 I.G. 1065), and
renumber the existing clause 40, Area Incidence and Duration to read as clause
41.
2. Delete
subclause (i) of clause 20, Annual Leave and insert in lieu thereof the
following:
(i) The
provisions of the Annual Holidays Act
1944, shall regulate the rights and obligations of the employer and employee in
respect of such annual holiday.
3. Delete
subclause (i) of clause 33, Change Rooms and Dining Rooms, and insert in lieu
thereof the following:
(i) See
Occupational Health and Safety Regulation 2001.
4. Delete
subclause (c) of clause 37, Superannuation, and insert in lieu thereof the
following:
(c) The employer
shall contribute to the Fund in accordance with the legislation provided that
employer contributions do not fall below 3% of ordinary time earnings:
5. Renumber
clause 39A, Deduction of Union Membership Fees, to read as clause 40 and
renumber clause 40, Area, Incidence and Duration to read as clause 41.
6. Insert at the
end of cause 41, Area, Incidence and Duration, the following new paragraphs:
The changes made to the award pursuant to the Award
Review pursuant to section 19(6) of the Industrial Relations Act 1996
and Principle 26 of the Principles for Review of Awards made by the Industrial
Relations Commission of NSW on 28 April 1999 (310 I.G. 359) and take effect on
23 December 2003.
This award remains in force until varied or rescinded,
the period for which it was made already having expired.
