INDUSTRIAL RELATIONS COMMISSION OF NEW SOUTH WALES

 

Review of Award pursuant to Section 19 of the Industrial Relations Act 1996.

 

(No. IRC 5680 of 2003)

 

Before Commissioner McLeay

REVIEWED AWARD

 

1.          Delete subclauses 6.1 and 6.4 of clause 6, Rest Pauses of the award published 26 October 2001 (328 I.G. 1087) and insert in lieu thereof the following:

 

6.1        Day workers will have two 10-minute rest pauses.  One rest pause shall be in the morning and one rest pause shall be in the afternoon.

 

6.4        Rest pauses will be counted as time worked and will be paid as such.

 

2.          Delete paragraph 8.11.2 of clause 8, Allowances and insert in lieu thereof the following:

 

8.11.2   Junior employees working in a laboratory, other than one employed as a cleaner or a bottle washer, will be paid an additional amount per week as set out in Item 17 of Table 2.

 

3.          Delete subclause 12.1 of clause 12, Overtime and insert in lieu thereof the following:

 

12.1      All time worked outside the ordinary rostered working hours will be overtime.  This time will be paid for at the rate of time and one-half for the first two hours and double time thereafter.

 

4.          Delete paragraphs 13.1.2 and 13.1.3 of clause 13, Mixed Functions and insert in lieu thereof the following:

 

13.1.2   If required to perform such work for two hours or more, but less than four hours, he/she will be paid for one half day or shift at the higher rate of pay prescribed for the work performed.

 

13.1.3   If required to perform such work for less than two hours, he/she will be paid the higher rate of pay prescribed for the work performed, for the time actually occupied on such work.

 

5.          The changes made to the award pursuant to the Award Review under section 19(6) of the Industrial Relations Act 1996 and Principle 26 of the Principles for Review of Awards made by the Industrial Relations Commission of New South Wales on 28 April 1999 (310 I.G. 359) take effect on and from 23 February 2004.

 

This award remains in force until varied or rescinded, the period for which it was made already having expired.
