INDUSTRIAL RELATIONS COMMISSION OF NEW SOUTH WALES

 

Review of Award pursuant to Section 19 of the Industrial Relations Act 1996.

 

(No. IRC 1868 of 2004)

 

 

REVIEWED AWARD

 

1.          Delete the words "Industrial and Commercial Training Act 1989 in subclause (a) of clause 3, Area, Incidence and Duration of the Award published 10 May 2002 (333 I.G. 380) and insert in lieu thereof the following:

 

"Apprenticeship and Trainee Act 2001".

 

2.          Delete the words "NOTE:  Amenities for workshops and depots are those prescribed by the Factories, Shop and Industries Act 1962, and by the Regulations made under the Act.  The amenities prescribed include change room, meal room, dining tables, chairs, clothes lockers, tool lockers, food storage, meal heating facilities, garbage bins, showers, hand wash basins and sanitary conveniences" from paragraph (b) subclause (i) of clause 22, Amenities and insert in lieu thereof the following:

 

"NOTE:  Amenities are required in line with the Occupational Health and Safety Act 2000 and associated Regulations".

 

3.          Delete subclause (viii) from clause 24, Miscellaneous Provisions and insert in lieu thereof the following:

 

(viii)     In line with the Occupational Health and Safety legislation and the associated Regulation it is recognised by the employer that live work is no longer allowed save for emergency situations. In such an emergency situation the appropriate documentation will be completed and safety equipment appropriate for the emergency work will be provided.

 

4.          The changes made to the Award pursuant to the Award Review under Section 19(6) of the Industrial Relations Act 1996 and Principle 26 of the Principles for Review of Awards made by the Industrial Relations Commission of New South Wales on 18 December 1998 (85 IR 38) take effect on and from 23 June 2004.

 

This Award remains in force until varied or rescinded, a period for which it was made already having expired.
