VARIATION

 

1.          Delete paragraphs (b), (c) and (d) of subclause (i) of clause 10, Holidays of the award published 29 July 2005 (352 I.G. 971), and insert in lieu thereof the following

 

(b)        The days on which the following holidays are observed shall be award holidays, viz., New Year's Day, Australia Day, Good Friday, Easter Saturday, Easter Monday, Queen's Birthday, Anzac Day, Eight Hour Day, Christmas Day, Boxing Day, together with any other days proclaimed or gazetted as a public holiday for the State. The first Tuesday in November each year, or such other day as agreed between the employer and the employee shall also be observed as a holiday, provided that in Queanbeyan, the first Tuesday in November each year shall be observed as the same day as Labour Day in the Australian Capital Territory.

 

(c)        The first Tuesday in November each year, (or such other say as agreed between the company and employees) shall also be observed as a holiday.

 

(d)        For the purpose of this subclause an employee shall be treated as working on one of the days specified in paragraph (a) if that employee works on a shift which is worked in order to produce bread for sale on one of such days even though the shift is not worked on one of such days.  The exception will be in the case of the first Tuesday in November each year, where the holiday will be the actual Tuesday and apply to those employees working the Tuesday for the production and delivery of bread into the market on Wednesday.

 

2.          This variation shall take effect on and from 17 March 2006.
