VARIATION
1. Delete clause
3.8, Safety Net Adjustments, of the award published 30 June 2000 (316 I.G.
961), and insert in lieu thereof the following:
3.8. Safety Net
Adjustments
The rates of pay in this award include the adjustments
payable under the State Wage Case 2006.
These adjustments may be offset against:
(a) any equivalent
overaward payments; and/or
(b) award wage
increases since 29 May 1991 other than safety net, State Wage Case, and minimum
rates adjustments.
2. Delete Part
7, Monetary Rates, and insert in lieu thereof the following:

The rates in Table 1A above include and consume the
"Industry Disability" allowance and the "Inclement Weather"
allowance, (i.e. the rates in Table 1B continue to attract the "Disability
Allowance" , Item 26, Table 2). Accordingly, the rates in Table 1A above
compensate employees for working in the open in quarries and thereby being
subject to climatic conditions such as dust blowing in the wind, sloppy and
muddy conditions and the lack of usual amenities associated with factory work
etc., and for the additional disabilities of being required to work when
exposed to inclement weather and for working in isolated and underdeveloped
locations. "Inclement weather" means wet weather and/or abnormal
climatic conditions such as hail, cold, high winds, severe dust storms, extreme
high temperatures or any combination thereof.

"Note": These allowances are contemporary for

3. This
variation shall take effect from the first full pay period to commence on or
after 13 November 2006.
