Nurses' (Private Sector) Training Wage (State) Award

 

INDUSTRIAL RELATIONS COMMISSION OF NEW SOUTH WALES

 

Review of Award pursuant to Section 19 of the Industrial Relations Act 1996.

 

(Case No. 288650 of 2018)

REVIEWED AWARD

 

1.         Delete the definition of "Association" in Clause 4, Definitions, of the award published 2 August 1996 (294 I.G. 77) and Award reprinted 27 January 2012 (372 I.G. 588), and insert in lieu thereof the following:

 

"Association" means the New South Wales Nurses and Midwives' Association.

 

2.         Delete the definition of "Relevant NSW Training Authority" in clause 4, and insert in lieu thereof the following:

 

"Relevant NSW Training Authority" means the Department of Education, or successor organisation.

 

3.         Delete the definition of "Relevant Union" in clause 4, and insert in lieu thereof the following:

 

"Relevant Union" means the New South Wales Nurses and Midwives’ Association which is entitled to enrol the Trainee as a member.

 

4.         Delete clause 12, Area, Incidence and Duration and insert in lieu thereof the following:

 

12.  Area, Incidence and Duration

 

(a)       This award shall apply to all classes of trainees who would ordinarily be covered by the following award:

 

Nursing Homes, &c., Nurses' (State) Award reprinted and published 27 January 2012 (372 I.G. 588), as varied;

 

(b)       The rates of pay in this award include the adjustments payable under the State Wage Case 2018. These adjustments may be offset against:

 

(a)       any equivalent overaward payments, and/or 

 

(b)       award wage increases since 29 May 1991 other than the safety net, State Wage Case, and minimum rates adjustments.

 

The rates of pay and allowances in Part B, Monetary Rates take effect from the first pay period on or after 28 September 2018.

 

The changes made to the award pursuant to the Award Review pursuant to section 19(6) of the Industrial Relations Act 1996 and Principle 26 of the Principles for Review of Awards made by the Industrial Relations Commission of New South Wales on 28 April 1999 (310 I.G. 359) take effect on and from 9 November 2018.

 

This award remains in force until varied or rescinded, the period for which it was made already having expired.
