VARIATION
1. Delete subclauses
2.2 and 2.3 of clause 2, Definitions, of the award published 29 July 2022 (392
I.G. 519) and insert in lieu thereof the following:
2.2 "Employer"
will mean the Department of Planning and Environment, at Taronga Conservation
Society Australia (Taronga), as defined in Part 1 of Schedule 1 in the Government
Sector Employment Act 2013.
2.3 "Employee"
will mean a person employed in the Department of Planning and Environment at
Taronga Conservation Society Australia (Taronga) within the scope of this
Award.
2. Insert after
subclause 12.3 of clause 12, Leave Conditions and Entitlements the following
new subclause:
12.4 Additional annual
leave
(a) In addition to
the annual leave entitlements provided for in subclause 12.1, an employee who
is rostered to work their ordinary shifts on Sundays and/or Public Holidays,
during the period of 1 December one year to 30 November the next year (or part
thereof), is entitled to additional annual leave on the following basis:
Number of ordinary
shift worked on Sundays and/or Public Holidays during a qualifying period of
12 months from 1 December one year to 30 November the next year

(b) By agreement
between the employee and their manager, but not unreasonably refused, an
employee entitled to additional annual leave under subclause 12.4(a), can elect
at any time to cash out part or all of the additional annual leave.
3. This variation
will take effect from 10 February 2023.
