VARIATION

 

1.        Delete the word "Industry" from the title of the Award published 23 December 2022 (393 I.G. 886).

 

2.        Delete clause 2, Title and insert in lieu thereof the following:

 

2.  Title

 

This award shall be known as Crown Employees (Department of Planning and Environment - National Parks and Wildlife Service) Field Officers and Skilled Trades Salaries and Conditions 2022 Award.

 

3.        Delete the amount "$173.84" in subclause 7.2 of clause 7, Allowances and insert in lieu thereof the following:

 

$200.50

 

4.        Delete paragraph 7.3.3 of subclause 7.3 of clause 7, Allowances and insert in lieu thereof the following:

 

7.3.3   The amounts payable per day of 24 hours, or part thereof (which must involve an overnight stay), are:

 

(i)       where meals are provided by DPE, $86.55 or $3.60 per hour

 

(ii)      where meals are not provided by the DPE $138.00 or $5.75 per hour

 

5.        Delete Table 1 and Table 2 of paragraph 7.4.5 of subclause 7.4 of clause 7, Allowances and insert in lieu thereof the following:

Table 2

 

Grade "A"

All locations in remote areas, as defined, except those specified as Grade B or C

and including Nadgee.

 

For the purpose of this Award the following locations will be included in Grades "B" and "C".

 

Grade "B"

is payable to employees living in the following locations:

Bourke, Brewarrina, Clare, Ivanhoe, Lake Mungo, Lightening Ridge, Louth, Mungindi, Pooncarie, Redbank, Walgett and Gwydir Wetlands.

Grade "C"

is payable to employees living in the following locations: Angledool, Barrigun Brindingabba, Culgoa, Enngonia, Fort Grey, Mutawintji, Mount Wood, Nocoleche, Olive Downs, Tibooburra, Yathong, Witta Brinna, Tarawi, Irymple, Lord Howe Island, Montague Island, Wanaaring, Weilmoringle, White Cliffs, Wilcannia, Willandra, Menindee, Kinchega, Macquarie Marshes and Gunderbooka.

 

6.        Delete the amount "$190" of paragraph 7.5.1 of subclause 7.5 of clause 7, Allowances and insert in lieu thereof the following:

7.        Delete the amount "$27.14" in subclause 7.5.3 of subclause 7.5 of clause 7, Allowances and insert in lieu thereof the following:

8.        Delete the word "calendar" where it appears in section (i)(a) of paragraph 13.4.3 of clause 13, Hours of Work and insert in lieu thereof the word "financial".

 

9.        Delete the number "13.4.6" in subparagraph (ii), of paragraph 13.4.3 of clause 13, Hours of Work and insert in lieu thereof the number "13.4.8".

 

10.      Delete the words "the Department" in paragraph 27.5.1 of subclause 27.5 of clause 27, Incident Conditions.

 

11.      Delete Table 4 in paragraph 27.5.1 of clause 27, Incident Conditions and insert in lieu thereof the following:

12.      Delete the words "the Department" in subclause 34.1 of clause 34, Engagement of Contractors and subclause 41.3 of clause 41, Deduction of Union Membership Fees.

 

13.      Delete clause 43, No Extra Claims and insert in lieu thereof the following:

 

43.  No Extra Claims

 

43.1    Other than as provided for in the Industrial Relations Act 1996 and the Industrial Relations (Public Sector Conditions of Employment) Regulation 2014, there shall be no further claims/demands or proceedings instituted before the NSW Industrial Relations Commission for extra or reduced wages, salaries, rates of pay, allowances or conditions of employment with respect to the Employees covered by the Award that take effect prior to 30 June 2024 by a party to this Award.

 

43.2    The terms of subclause 43.1 do not prevent the parties from taking any proceedings with respect to the interpretation, application or enforcement of existing Award provisions.

 

14.      Delete paragraph (i) of subclause 44.2, of clause 44, Area, Incidence and Duration and insert in lieu thereof the following:

 

(i)       that transferred to the DPE where these employees occupied positions which are the subject of any other awards under Administrative Order of 2 April 2007 and subsequent Orders which established Department DPE of Environment and Climate Change effective 27 April 2007; or

 

15.      Delete tables 1 and 2 of Part B, Monetary Rates and Classifications, and insert in lieu thereof the following:

Level 1

 

 

Base trade. Appointees Employees at this level must have appropriate trade qualifications.

 

 

 

 

 

Level 2

 

 

Base trade plus the ability to perform general park maintenance duties, when required.

 

 

 

 

 

Level 3

 

 

A tradesperson who is able to:

- work with the minimum amount of supervision;

- work with the minimal amount of technical direction;

- solve technical problems;

- meet deadlines;

- ensure quality control of work; and

- perform general park maintenance duties when required.

 

 

 

 

 

Level 4

 

 

Senior Tradesperson

 

 

is a tradesperson who possesses the skills, knowledge, qualifications, and competencies that are superior to those required by a tradesperson Level 3; or supervises the work of other tradespersons, including setting work priorities and allocating tasks.

 

 

 

 

 

Level 5

 

 

Assignment to a role at this level is by competitive selection to advertised vacancies. This level includes the Maintenance Supervisor role, which is responsible for the Field Officers of a district.

A trade role which is evaluated at this level will be filled by competitive selection. Payment at this level recognises all skills, knowledge, competencies, licences, registrations and experience necessary for a role at this level.
