INDUSTRIAL RELATIONS COMMISSION OF NEW SOUTH WALES

VARIATION

 

1.         Delete the definition of "Chief Executive" in paragraph (a) of subclause 3.1 of clause 3, Definitions, of the award published 20 March 2020 (387 I.G. 318) and reprinted 24 November 2023 (395 I.G. 1303).

 

2.         Delete clause 4, Area, Incidence and Duration and insert in lieu thereof the following:

 

4.  Area, Incidence and Duration

 

4.1      This Award shall apply to the Secretary of the Department of Transport as head of the Transport Service, the Unions and to Employees.

 

4.2      This Award shall commence from 1 July 2019, and shall have a nominal expiry date of 30 June 2021. This Award remains in force until varied or rescinded, the period of which it was made already having expired.

 

4.3      This Award rescinds and replaces the Roads and Maritime Services (Wages Staff) Award 2017 published 9 February 2018 (382 I.G. 538).

 

4.4      Any specific provisions contained in section 7 of this Award shall take precedence to the extent of any inconsistency over the general provisions contained in sections 1 - 6 of this Award.

 

3.         Delete Clause 5, No Extra Claims and insert in lieu thereof the following:

 

5.  No Extra Claims

 

5.1      The Industrial Relations Commission recognises that the parties have provided an undertaking that other than as provided for in the Industrial Relations Act 1996 there will be no further claims/demands or proceedings instituted before the NSW Industrial Relations Commission for extra or reduced wages, salaries, rates of pay, allowances or conditions of employment with respect to the employees covered by the Award that take effect prior to 30 June 2025 unilaterally made by a party to this Award unless otherwise agreed by the parties.

 

5.2      This undertaking does not prevent the Parties from continuing collaborative discussions during the life of the Award to deliver additional enhancements to remuneration and/or conditions of employment, and to achieve additional industry wide and systemic efficiencies and productivity improvements to the delivery of Government services to the public. Changes to conditions or salaries may be jointly progressed and, if agreed, an application to vary the Award may be made by consent prior to 30 June 2025.

 

5.3      The parties to this Award acknowledge that the intention of subclause 5.2 is to facilitate discussions prior to 30 June 2025.

 

5.4      The terms of clause 5.1 do not prevent the parties from taking any proceedings with respect to the interpretation, application or enforcement of existing Award provisions.

 

5.5      Variations made with the agreement of the parties are not prohibited by this clause.

 

4.         Delete subclause 6.1 of clause 6, Anti-Discrimination and insert in lieu thereof the following:

 

6.1      It is the intention of the Parties to seek to achieve the object in section 3(f) of the Industrial Relations Act 1996 to prevent and eliminate discrimination in the workplace. This includes discrimination on the grounds of race, sex, marital status, disability, homosexuality, transgender identity, age and responsibilities as a carer and any other ground provided for in the Anti- Discrimination Act 1977 (NSW) or applicable Commonwealth anti-discrimination legislation.

 

5.         Delete paragraph 23.1(a) of clause 23, Rates of Pay, and insert in lieu thereof the following:

 

(a)       3.5% from the first full pay period to commence on or after 1 July 2024.

 

6.         Delete subclause 28.4 of clause 28, Payment For Time Spent Travelling (excluding Distant Work), and insert in lieu thereof the following:

 

28.4    Where employees are required by RMS/Transport to start or finish work at a worksite or alternate depot (which is not their designated depot in accordance with clause 28.1) and they travel directly to or from their home to that location, the time taken to travel directly from or return to an employee’s home in excess of 10 minutes each way on each occasion will be paid as time worked including at overtime rates where applicable in accordance with the Award. Any travel time in excess of 10 minutes each way on each occasion will be recorded as time worked.

 

7.         Delete Part B, Monetary Rates and insert in lieu thereof the following:
