KU CHILDREN'S SERVICES (OTHER THAN TEACHERS) (STATE) CONSENT AWARD 2000

 

INDUSTRIAL RELATIONS COMMISSION OF NEW SOUTH WALES

 

Application by Australian Liquor, Hospitality and Miscellaneous Workers Union, New South Wales Branch, industrial organisation of employees.

VARIATION

 

1.          Insert in numerical order in clause 1, Arrangement of the award published 4 May 2001 (324 I.G. 615), the following new clause number and subject matter:

 

17a.  Staff Meeting - Long Day Care

 

2.          Delete clause 4, Contract of Employment, and insert in lieu thereof the following:

 

4.  Contract of Employment

 

(i)         Except for the first eight (8) weeks of employment, the employment of a weekly employee may be terminated by seven working days' notice given by either party or by the payment or forfeiture, as the case may be, of seven days' wages in lieu of such notice.  This shall not affect the right of the employer to dismiss any employee without notice for misconduct and in such cases wages shall be paid up to the time of dismissal only.

 

During the first eight weeks of employment, the employment may be terminated by a day's notice, given by either party, or by the payment or forfeiture, as the case may be, of one day's wages in lieu of such notice.

 

An employee dismissed before the expiration of such eight weeks shall be considered a casual employee and shall be paid the rates prescribed for a casual employee in clause 12, Casual Employees.

 

(ii)        The employment of a casual employee may be terminated by one hour's notice.

 

(iii)       For full-time and part-time employees, upon request by an employee, the employer shall give an employee a signed statement of service upon termination.  Such statement shall certify the length of service, the age of children supervised and the positions held by such employee.

 

(iv)       For full-time and part-time staff, employees on termination of employment shall be paid all wages and other monies due forthwith, including any payments which may be due in lieu of annual leave and/or long service leave.

 

(v)        The Redundancy provisions of the parent award shall apply to all employees including those working in AMEP.

 

3.          Delete paragraph (vi), of subclause (a) of clause 17, In-Service Courses, and insert in lieu thereof the following:

 

(vi)       "In- Service" shall be deemed to include parent meetings and committee meetings, attendance at Annual Seminar, attendance at Regional Meetings or other approved in-service courses.

 

4.          Insert after clause 17, In-service Courses, a new clause 17A.

 

17A.  Staff Meeting - Long Day Care

 

1.          Attendance at a staff meeting shall be subject to the following:

 

(i)         Adequate notice is to be given to an employee of the meeting;

 

(ii)        The maximum amount to be claimed as time-in-lieu in each consecutive calendar year of employment  is 16 hours - such attendance shall mean 16 hours of meeting time;

 

(iii)       Circumstances may arise where KU requires an employee to attend a staff meeting for more than the required 16 hours face to face.  Should this exceed the maximum accrual of 16 hours per calendar year, the employee will be entitled to the payment of overtime in accordance with Clause 12, Overtime of the Miscellaneous Workers - Kindergartens and Child Care Centres (State) Award;

 

(iv)       Travelling time and meal/tea breaks shall be excluded from such time of attendance.

 

2           The operation of this clause shall be subject to an annual review by KU, in consultation with the Union, conducted 12 months following the introduction of this clause into the Award.

 

5.          Delete Part B: Monetary Rates, and insert in lieu thereof the following:
