VARIATION
1. Delete
clause 32, Redundancy and clause 33, Superannuation from the arrangement, of
the award published 29 July 2022 (392 I.G. 545) and renumber subsequent clauses
accordingly.
2. Insert
an apostrophe after the words “24 hours” in paragraph 3.8.5 of clause 3, Hours
of Employment, to read as 24 hours’.
3. Delete
duplicated clause 22 “Parental Leave” which reads “See Part 4 of Chapter 2 of
the Industrial Relations Act 1996.”
4. Delete
subclause 30.3 of clause 30, Mixed Functions.
5. Delete
subclause 31.1 of clause 31, Termination of Employment and insert in lieu
thereof the following:
31.1 The employment of a weekly or part-time
employee may be terminated by either side providing the below notice, which may
be given at any time or by payment by the employer or forfeiture by the
employee of a week's pay in lieu of notice.

In addition to
the notice above, employees over 45 years of age at the time of the giving of
the notice, with not less than two years continuous service, will be entitled
to an additional week s notice.
This shall not
affect the right of the employer to dismiss an employee without notice in the
case of an employee guilty of misconduct.
6. Delete
clauses 32, Redundancy and 33, Superannuation from the body of the award and
renumber remaining clauses accordingly.
7. Delete
clause 48, Area, Incidence and Duration” (formerly clause 50), and in lieu
thereof the following:
48. Area, Incidence and Duration
This award applies
to employees of the classifications specified herein within the jurisdiction of
the Transport Industry (State) Industrial Committee.
This award rescinds
and replaces the Transport Industry (State) Award, published 29 July 2022 (392 I.G.
545) and shall operate on and from the beginning of the first pay period to
commence on or after 1 July 2024 until 30 June 2025.
This award remains
in force until rescinded.
8. Delete
Table 7 – Allowances of Part B, Monetary Rates and insert in lieu thereof the
